Sections 32 to 51 Chap. The Minister shall, with the approval of the National Environment Board, formulate an action plan called "Environmental Quality Management Plan" to implement the national environment policy sect. Sections 42 to 45 provide for the establishment of national parks, wildlife reserves watershed areas, and other protected areas. It shall submit a pollution prevention action plan to the Board and carry out other functions outlined in section The Board shall have the power to declare pollution control areas under section Sections 69 to 77 concern the prevention of water pollution.

Section 70 introduces an obligation to treat wastewater by owners or possessors of sources of pollution, whereas section 80 requires the same to collect statistics and other data and to report on polluting activities. Sections 94 and 95 provide for financial assistance by the Government to owners or possessors of sources of pollution in investing in anti-pollution measures. Final provisions of the Act deal with civil liability of polluters and prescribe offences and penalties.

His Majesty King Bhumibol Adulyadej is graciously pleased to proclaim that: Whereas it is expedient to have the law on the National Energy Policy Council; Be it, therefore, enacted by the King, by and with the advice and consent of the National Legislative Assembly acting in the capacity of the National Assembly, as follows: Section 1. Section 2. This Act shall come into force as from the day following the date of its publication in the Government Gazette. All other laws, by-laws and regulations in so far as they have already been provided in this Act or are contrary to or inconsistent with the provisions of this Act shall be replaced by this Act. Section 4. In this Act: "energy" means an ability to perform the work inherent in the sources capable of generating powers, which are renewable energy and non-renewable energy, and shall include the sources which may generate powers such as fuel, heat, and electricity; "renewable energy" includes energy obtained from wood, firewood, paddy husk, bagasse, biomass, hydropower, solar power, geothermal power, wind power, and waves and tides; "non-renewable energy" includes energy obtained from coal, oil shale, tar sands, crude oil, oil, natural gas and nuclear power; "fuel" includes coal, oil shale, tar sand, oil, natural gas, fuel gas, synfuel, wood, firewood, paddy husk, bagasse, garbage and other sources as prescribed by the National Energy Policy Council and published in the Government Gazette. According to the Act, the Environmental Quality Board is established. The Environmental Quality Board has powers and duties in submitting policy and governing related agencies in environmental quality management. Examples of powers and duties of the Board are to submit policy and plan; to consider and approve the Environmental Quality Management Plan, Provincial Action Plan for environmental quality management, the action plan for prevention and remedy of danger caused by contaminations of pollutants, the setting of emission of effluent standards and to specify measures for the strengthening and fostering of co-operation and co-ordination among government agencies and private sectors. As the promotional measures in the Act, owners of the possessors of any point source pollution who has to install on-site facility for pollution treatment are entitled to request the National Environmental Board for promotional supports import duties of necessary machinery, equipment, instruments, tools, appliances or material which are not available in the Kingdom; and permission to bring foreign experts or specialists to carry out work in relation to pollution management when qualified person in the Kingdom are not available and assistance from the responsible government agencies.
